Terms & Conditions

These terms apply to booking requests and trips (diving & kite safaris, courses, private charter) with Azure Safari. Legal form, address and contact are in the Imprint. Please read carefully before booking.

1. Conclusion of the travel contract

By registering, the traveller (“the Traveller”) makes a binding offer to Azure Safari to conclude a travel contract — including for all co-registered participants, for whose obligations the Traveller is responsible. A booking sent via the website is first a non-binding request; the contract is formed only once we confirm it in writing.

2. Offer validity

An offer made on request is valid for 4 weeks from receipt. After that it may be recalculated (e.g. exchange-rate movements, price or legal changes).

3. Prices & currency

Prices are as stated; amounts shown in other currencies are indicative. The amount and currency in your booking confirmation are binding.

4. Deposit & payment

A deposit of 20% of the safari price is due on receipt of the booking confirmation; the balance is due, without further reminder, no later than 30 days before departure. For short-notice bookings the full price is due immediately. Flights are invoiced separately. Travel documents are issued approx. 7 days before departure after full payment. Late payment may incur reminder fees or exclusion from the trip.

5. Services & programme

The scope of services follows from the offer, the website and the booking confirmation. Services generally apply from the destination airport; arriving in time at the point of departure is the Traveller's responsibility.

6. Changes to services & prices

On multi-day boat trips, routes may change at short notice for weather or safety reasons or due to local regulations; the route may be adapted to the group's actual diving ability. No refund is given for weather-related changes or trip interruption, nor for additional permit/marine-park fees. In adverse circumstances we may rebook to an equivalent boat. We will inform you of significant changes and, where applicable, offer a free rebooking or cancellation or reasonable compensation.

7. Cancellation by the customer / cancellation fees

The Traveller may withdraw at any time before departure; the date we receive the written cancellation is decisive. Flat cancellation fees per participant:

  • from booking up to 90 days before departure: 20% of the trip price
  • 89 to 60 days before departure: 50%
  • 59 to 30 days before departure: 80%
  • 29 to 15 days before departure: 90%
  • 14 days up to departure: 100%
  • No-show: 100%

8. Substitute participant

Up to 15 days before departure, a third party may take the Traveller's place, provided we are notified and the person meets the trip requirements. The Traveller and the substitute are jointly liable for the price and any additional costs; a processing fee of [processing fee] also applies. Cancellation, rebooking and change requests should be made in writing for evidentiary reasons.

9. Services not used

If individual services are not used, we will seek a refund of saved costs from the service providers, unless the services are insignificant or legal provisions prevent it.

10. Withdrawal & termination by the provider

We may terminate without notice if the Traveller persistently disrupts the trip or behaves in serious breach of contract. Up to two weeks before departure we may withdraw if the minimum number of participants is not reached; in that case the amount paid is refunded without delay.

11. Force majeure

If the trip is significantly impeded, endangered or impaired by force majeure unforeseeable at the time of contract, either party may terminate. Services already rendered or still required to end the trip may be reasonably compensated.

12. Liability

Within our duty of care we are liable for conscientious trip preparation, the careful selection and supervision of service providers, and the proper provision of the contractually agreed services.

13. Warranty

If the trip is not provided as agreed, you may demand remedy. Defects must be reported in writing without delay to the (local) trip guide, otherwise to the provider or service provider; failing to report a defect forfeits claims for price reduction or damages. For services where we act only as an intermediary, the operating provider is liable under its own terms.

14. Passport, visa, customs, currency & health requirements

The Traveller is solely responsible for complying with passport, visa, customs, currency and health requirements; we accept no liability for refused entry.

15. Limitation of liability

Liability for damage other than personal injury is limited to three times the trip price, unless caused intentionally or through gross negligence, or where we are liable solely due to a service provider's fault. Statutory and international liability limits remain unaffected. Diving and boat excursions are at your own risk; boats, dive equipment and dives are not insured — the Traveller is responsible for appropriate insurance. We are not liable for location-specific technical breakdowns.

16. Exclusion of claims & limitation period

Claims for a trip not provided as agreed must be asserted within one month of the contractual end of the trip. Travel-contract claims expire after six months; claims in tort after three years.

17. Insurance

We strongly recommend trip-cancellation, baggage, accident and health insurance — in particular a dedicated dive insurance covering rescue, decompression-chamber costs and repatriation in the event of a diving accident.

18. Diving prerequisites

By registering, the Traveller declares there are no medical objections to participation. You must carry a dive-medical certificate (no older than 1 year at the end of the trip), a recognised valid certification (e.g. PADI Open Water, CMAS* or higher) and a logbook. Instructions from instructors and guides must be followed; non-compliance or missing certificates lead, for safety reasons, to immediate exclusion without refund (including exceeding prescribed depth limits).

19. Governing law & jurisdiction

[Governing law] applies. Place of jurisdiction, where permitted, is [place/jurisdiction].

20. Data protection

Personal data the Traveller provides to handle the trip is protected against misuse. Details are in our Privacy Policy.
